The State Council of Higher Education for Virginia (SCHEV) issues the domicile guidelines that Virginia colleges and universities use to determine a student's eligibility for in-state tuition:

How to Establish Virginia Residency (Domicile)

As required by the SCHEV guidelines, an individual must demonstrate, with clear and convincing evidence, residence in Virginia and an intent to remain in Virginia indefinitely to establish domicile in Virginia. After meeting the requirements to establish domicile, a person must continue to be domiciled in Virginia for at least 12 months prior to the first day of classes. A college or university may ask for information from you or your parents about the following factors:

  • Continuous residence in Virginia
  • Federal/State income tax
  • Driver's License or Identification Card
  • Motor vehicle registration
  • Voter registration
  • Military records
  • Additional information if required or requested

After the first day of the semester, domicile status (and out-of-state tuition rates) cannot be changed.  Appeals will be considered for the next semester.  How to appeal an out-of-state tuition status.
